Key Definitions in Membership Scheme Terms

1.Member

A person who has successfully registered and paid the required membership fee for the Maxx Saver’s Club membership scheme and is entitled to access the benefits and privileges offered by the membership. 

2.Membership

A contractual arrangement between  SAVEMAXX(Store) and the member, providing the member with exclusive benefits, discounts, or privileges for a defined period, usually one year, subject to renewal. 

3.Membership Card

A physical or digital card issued to the member, which must be presented to access membership benefits, discounts, or services within the store. 

4.Membership Fee

The amount of money that the member is required to pay upon registration and/or annually to maintain active membership status. This fee is non-refundable except as specified in the membership terms. 

5.Membership Benefits

The various exclusive services, offers, discounts, or privileges provided to members as part of the membership, which may include access to special pricing, events, promotions, or rewards. 

6.Non-Member

Any individual who does not hold an active membership with the store and is therefore not entitled to the benefits offered to members. 

7.Member Account

The personalized account associated with a member, which contains their registration details, membership status, purchase history, and any other relevant data. 

8.Annual Renewal

The process of renewing the membership for another term, typically at the end of each year, and paying the corresponding fee to maintain the benefits of the membership. 

9.Exclusive Offers

Promotions, discounts, or events that are available only to members and not to non-members. These offers are typically time-limited and subject to availability. 

10.Ineligibility

A condition where a member may be disqualified from receiving benefits due to violation of membership rules, fraud, misuse of the membership, or failure to pay the membership fee. 

11.Membership Cancellation

The act of terminating or discontinuing the membership by the member or the store, either voluntarily by the member or involuntarily due to violation of terms or inactivity. 

12.Store

Refers to the physical or online retail entity offering the membership scheme, which may include a specific business name, website, or branch location. 

13.Promotional Period

A limited timeframe during which members can access additional benefits, such as seasonal sales, extra discounts, or early access to new products. 

14.Transfer of Membership

A prohibited or authorized action allowing the member to assign or transfer the membership or benefits to another individual. Typically, memberships are non-transferable. 

15.Terms and Conditions

The set of rules and regulations governing the membership scheme, which all members must agree to and abide by to enjoy the benefits of membership. 

16.Refund Policy

The store’s policy regarding refunds or adjustments to membership fees, particularly in the event of cancellation or early termination of the membership. 

17.Member Benefits Program

A loyalty or reward system that may be offered to members, where points or credits are earned through purchases and can be redeemed for discounts, products, or other rewards. 

18.Store Rules

The guidelines and operational rules established by the store, which members are required to follow while in-store or while using any services, such as returning products, participating in promotions, or interacting with staff. 

19.User Privacy

Refers to the protection of personal information collected from members as part of the membership registration process, which is governed by the store’s privacy policy. 

20.Termination of Membership

The cessation of the member’s participation in the membership scheme, either due to the member’s own request, failure to comply with terms, or as determined by the store for breach of policies. 

21.Discount Limits

The maximum amount or percentage discount a member can receive on certain products or services as part of their membership benefits, which may vary by promotion. 

 

Membership Terms and Conditions 

1. Eligibility and Registration 

• Membership is available to individuals aged 18 years and older, subject to successful registration. 
• To become a member, you must complete the registration process online or  in-store, providing  accurate personal details, including name, email address, and contact information. 
• ∙Each member must hold a valid membership card, which may not be transferred or shared  with others. 

2. Membership Fees 

• Annual membership fees are payable upon registration and renewal, as outlined on the membership sign-up page or in-store. 
• Membership fees are non-refundable, except in cases of fraud or as mandated by law. 
• The membership fee is subject to change, with prior notice given to existing members. 

3. Membership Benefits

• Members are entitled to access exclusive discounts, offers, and promotions that are not available to non-members. 
• Benefits may include but are not limited to: bulk pricing, early access to sales,  free shipping on certain orders, and in-store discounts. 
• Additional benefits may be introduced and are subject to modification by the store at any time, with notice to members. 

4. Member Obligations 

• Members must present a valid membership information upon request to take advantage of benefits. 
• Members are required to adhere to all store rules, regulations, and policies during their visit, including those relating to store conduct, health and safety, and product returns. 
• Membership benefits are for personal, non-commercial use only. 

5. Membership Renewal and Cancellation 

• Membership is automatically renewed on the anniversary of your sign-up date, and the renewal fee will be charged to the payment method on file unless cancelled by the member. 
• Members may cancel their membership at any time by providing written notice to the store, and a refund of any unused portion of the annual fee may be issued at the retailer’s discretion. 

       6.Membership Refund 

• If membership is cancelled before the renewal date, the member will continue to enjoy membership benefits until the end of the current membership period. Monthly membership will end at the end of the month. For yearly membership remaining portion of the year will be refunded any unused portion of the annual fee as per the refund policy. 

7. Privacy and Data Protection 

• The store will collect and process personal data in accordance with privacy laws and the store’s privacy policy. 
• ∙Members consent to receiving communications related to their membership, including promotional offers, important notices, and updates about the store’s products and services. 

8. Use of Membership 

• The membership is for personal use only. Members may not sell, share, or use membership benefits for commercial purposes or in connection with any third-party businesses. 
• The store reserves the right to terminate or suspend a membership at any time if there is evidence of misuse, including fraudulent activities or violation of the T&C’s. 

9. Product Returns and Refunds 

• Members are entitled to return eligible items in accordance with the store’s return policy. 
• Returns or exchanges may be subject to time limits or other conditions as outlined in the store’s return policy. 

10. Limitation of Liability 

• The store is not liable for any loss, damage, or injury arising from the use of the  membership, products, or services provided, except as required by law. 
• The store’s liability for any issue arising from the membership scheme is limited to the total membership fee paid by the member. 

11. Amendments to the Terms 

• The store reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to members via email or on the store’s website. 
• Members are advised to review these Terms regularly to stay informed of any updates. 

12. Governing Law 

• These Terms and Conditions are governed by the laws of province of New Brunswick, and any disputes will be resolved in the appropriate court within that jurisdiction.
